1 The plaintiff in error, Mack Hutchinson, who will hereinafter be referred to as defendant, was charged by information filed in the Superior Court of Comanche County with the crime of rape in the first degree, was convicted and his punishment fixed by the jury at imprisonment in the State Penitentiary for a term of fifty years. Appeal has been duly perfected to this Court.
